SUPPLEMENTAL PRIVACY NOTICES

 

NOTICE FOR CALIFORNIA RESIDENTS

 

This Supplemental California Privacy Notice only applies to our processing of personal information that is subject to the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 ("CPRA"). The CPRA provides California residents with the right to know what categories of personal information Trainmakr has collected about them and whether Trainmakr disclosed that personal information for a business purpose (e.g., to a service provider) in the preceding 12 months. California residents can find this information below:

"Sales" of Personal Information under the CCPA

 

For purposes of the CCRA, Trainmakr does not "sell" personal information, nor do we allow any personal information to be used by third parties for their own marketing purposes (except where you explicitly requested or provided consent for us to do so). Trainmakr has no actual knowledge of any "sale" of personal information of minors under 16 years of age. However, we use analytics tools and other Technologies (as described above), which may be construed as a "sale" under CCRA to which you may opt-out of.

Additional Privacy Rights for California Residents

 

Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.

 

Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent, please contact us as set forth in "Contact Us" below and provide written authorization signed by you and your designated agent.

 

Verification. To protect your privacy, we will take steps the following steps to verify your identity before fulfilling your request. When you make a request, we will ask you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include asking you for additional proof of identity and asking questions regarding your account and use of our Services.

 

If you are a California resident and would like to exercise any of your rights under the CCRA, please contact us as set forth in "Contact Us" below. We will process such requests in accordance with applicable laws.

 

Accessibility. This Privacy Policy uses industry-standard technologies and was developed in line with the World Wide Web Consortium’s Web Content Accessibility Guidelines, version 2.1. If you wish to print this policy, please do so from your web browser or by saving the page as a PDF.

 

California Shine the Light. The California "Shine the Light" law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties.

 

Right for minors to remove posted content. Where required by law, California residents under the age of 18 may request to have their posted content or information removed from the publicly-viewable portions of the Services by contacting us directly as set forth in Contact Us below or logging into their account and removing the content or information using our self-service tools.

SUPPLEMENTAL NOTICE FOR RESIDENTS OF NEVADA, VIRGINIA, COLORADO, CONNECTICUT AND UTAH

 

This supplemental notice only applies to our processing of personal information that is subject to the privacy laws of the states of Virginia, Colorado, Connecticut, Utah and other applicable US states and the rights afforded to them under the the Virginia Consumer Data Protection Act (“VCDPA”), the Colorado Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), the Utah Consumer Privacy Act (“UCPA”) and other applicable laws.

 

For details about the personal information we have collected as a business over the last 12 months, please see the Section above of this Supplemental policy‎ (“Supplemental Notice for California Residents”). We collect this information for the business and commercial purposes described in our Privacy Policy linked here. We share this information with the categories of third parties described in our policy. We do not sell (as such term is defined in the CCPA or other US privacy state laws) the personal information we collect (and will not sell it without providing a right to opt out). We do share information with third parties for the purpose of cross-context behavioral advertising or targeted advertising. You may opt out of the sharing of your data for such purposes by contacting us at dailypump@trainmakr.com.

 

Subject to certain limitations, applicable US state laws provide consumers the right to request to know more details about the categories or specific pieces of personal information we collect (including how we use and disclose this information), to access their  information in a portable format, to correct or delete their personal information, to opt out of any “sales, cross-contextual behavioral advertising or targeted advertising” that may be occurring, and to not be discriminated against for exercising these rights. To make such requests, please send an email to dailypump@Trainmakr.com. Government identification may be required. Consumers can also designate an authorized agent to exercise these rights on their behalf.

 

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. Please note that we do not currently sell your Personal Information as sales are defined in Nevada Revised Statutes Chapter 603A. SUPPLEMENTAL NOTICE FOR EU AND UK CUSTOMERS.

If you are located in the European Union (“EU”) or the United Kingdom ("UK"), this section provides information regarding your rights, Trainmakr’s responsibilities, and additional information regarding the processing of your personal data.

 

Lawful Basis of Processing

Trainmakr processes personal data of persons in the EU and UK based on the lawful basis outlined below. 

 

Where multiple bases are provided, the basis that Trainmakr relies on for any particular processing will be context-dependent.

EU and UK User Rights

If you are located in the EU or the UK, you have the following rights with respect to how Trainmakr processes your personal data.

  1. You have the right to request a copy of the personal data that Trainmakr has about you,

  2. You have the right to request that Trainmakr correct the information about you if you believe it to be inaccurate, and

  3. You have the right to request that Trainmakr erase or refrain from using your personal data.  This is not an absolute right and, in some circumstances, Trainmakr may decline to erase or limit its usage of your data, such as when Trainmakr has an ongoing business relationship with you or we are legally required to retain the information.  If Trainmakr cannot honor your request, Trainmakr will inform you of this fact as well as the reasons for Trainmakr’s decision.

If you are located in the EU or the UK, you also have the right to raise any objections regarding the processing of your personal data and to raise any concerns you may have about Trainmakr’s processing of your personal data.  You may make an objection or raise any other concerns by submitting your concerns to us at dailypump@trainmakr.com

 

While we hope that Trainmakr can resolve any of your privacy concerns to your satisfaction after you contact us directly, you also have the right to file a complaint regarding Trainmakr’s handling of your personal data with the EU data protection authorities (DPAs) and/or the Information Commissioner’s Office (the UK’s Data Protection Authority).
